“EPA’s New Coal Combustion Residuals Rule – Implications for Future Litigation, Impoundments, and Beneficial Use”

With its new Coal Combustion Residuals (CCR) rule, EPA enhanced regulation of CCR by establishing national standards using existing RCRA Subtitle D authorities, and by structuring the requirements as self-implementing and enforceable by states and citizens. This presentation will discuss the fundamentals of EPA’s new regulations for CCR disposal and beneficial use, and practical implications of the regulatory structure in the context of hazardous and solid waste regulatory principles. The presentation will cover the significance of CCR regulation under Subtitle D of RCRA, the state/federal relationship, and implications for future litigation. The presentation will also discuss the unique requirements and issues presented for CCR impoundments.

Bryan Moore is a principal with Beveridge & Diamond P.C. and helps industrial, commercial, and oil and gas industry clients navigate and resolve contested environmental permitting proceedings, compliance audits, enforcement actions, and litigation so they can construct, operate, and expand their facilities. Bryan represents clients in matters arising under nearly every major federal and Texas environmental program in state and federal courts, as well as before agencies including the U.S. EPA, the Texas Commission on Environmental Quality, and the Railroad Commission of Texas. He serves on the firm’s Management Committee, and chairs the firm’s Waste Management and Recycling Practice.
