Energy Policy Issues under the New Biden Administration: A Federal & State Perspective

A new presidential administration, a Special Presidential Envoy for Climate, new leadership in both Houses of Congress, and a full complement of FERC Commissioners for the first time in a long while... What does this new era portend for energy and electricity policy? George Fibbe, Partner at Baker Botts and former DOE Deputy Counsel, and Devin Hartman, Director of Energy and Environmental Policy at the R Street Institute, will share their insights and perspectives on the implications for energy and electricity at the federal and state level.

George Fibbe represents clients in complex commercial disputes and regulatory matters. George's practice focuses on high-stakes matters across the energy sector, including upstream and midstream oil and gas, LNG, renewables, nuclear, and the power industry. Before joining Baker Botts as a partner, he served as Deputy General Counsel for Litigation, Regulation & Enforcement for the U.S. Department of Energy, where he oversaw a wide range of legal matters arising from the Department's missions of advancing energy security, promoting scientific innovation, ensuring security and environmental cleanup of the nation's nuclear weapons complex, and other energy-related operations. In that role, he worked closely with the Department of Justice, the Office of Management & Budget's Office of Information and Regulatory Affairs (OIRA), and other federal agencies.

At DOE, George was responsible for the Department's large-scale complex litigation and pre-litigation matters, including major environmental and nuclear waste related matters, regulatory and administrative claims, contractor disputes, intellectual property and other commercial contracts, employment and whistleblower disputes, and land acquisition. He also was lead counsel for departmental rulemakings and related regulatory and administrative matters, including serving as chair of the Department's deregulatory task force. He was responsible for all civil enforcement matters of the Department and headed the team dedicated to enforcement of energy efficiency standards for manufacturers. George received a BA in political science from Birmingham-Southern College and a JD from Harvard Law School. 

Devin Hartman is director of Energy and Environmental Policy at the R Street Institute. He leads a team that brings a pragmatic and analytically sound pro-market perspective to energy and environmental policy. He rejoined R Street in 2020 after serving as the president and CEO of the Electricity Consumers Resource Council (ELCON), the national association of large industrial users of electricity.

Before ELCON, Devin established R Street’s electricity policy program in 2016 based on principles of market competition, consumer choice and good governance. He has previously worked for the Federal Energy Regulatory Commission, the Indiana Utility Regulatory Commission, the U.S. Environmental Protection Agency and various energy and environmental policy nonprofit organizations. Devin received a BS in economics and BA in political science and environmental studies from Iowa State University, and holds an MPA and an MS in environmental science from Indiana University. He is an active member and past council member of his local chapter of the U.S. Association for Energy Economics. He lives in Washington, D.C. with his wife and retriever puppy.
